Succession regulation with Commission Implementing Regulation (EU) 2020/568 entered into force on April 26, 2020.
The Commission Implementing Regulation (EU) 2020/402 of March 14, 2020 on the introduction of the obligation to present an export license for the export of certain products imposed an authorization requirement for the export of personal protective equipment to third countries. This anticipated a limited validity period of six weeks (Art. 3 of Implementing Regulation (EU) 2020/402).
A succession plan was created by Commission Implementing Regulation (EU) 2020/568 of 23 April 2020 on the introduction of an obligation to submit an export license for the export of certain products (OJ (EU) L 129/7 of 24.04.2020), which came into force on April 26, 2020. It is valid for a period of 30 days (Art. 6 of the Implementing Regulation (EU) 2020/568).
The Implementing Regulation (EU) 2020/568 stipulates an authorization requirement for exports of the goods listed in Annex I.
Appendix II contains the form for the required export license.
Shipments (deliveries within the EU customs territory) are not restricted by Implementing Regulation (EU) 2020/568.
Exports to the following countries are also not restricted:
- Republic of Albania
- Andorra
- Bosnia and Herzegovina
- Faroe Islands
- Gibraltar
- Republic of Iceland
- Kosovo
- Principality of Liechtenstein
- Montenegro
- Kingdom of Norway
- Republic of North Macedonia
- Republic of San Marino
- Serbia
- Switzerland
- Vatican City
- United Kingdom of Great Britain and Northern Ireland
- Busingen
- Helgoland
- Livigno
- Ceuta
- Melilla as well
- to the overseas countries and territories listed in Annex II to the Treaty on the Functioning of the European Union (page 284 in PDF version)
Examples of products not covered by Annex I to Implementing Regulation (EU) 2020/568:
• Self-sewn mouth-nose covers from private production (so-called “community masks”).
• Sterile protective clothing or gloves.
