{"id":7231,"date":"2025-04-04T13:56:53","date_gmt":"2025-04-04T11:56:53","guid":{"rendered":"https:\/\/nicola-bernard.de\/?p=7231"},"modified":"2025-04-04T13:56:53","modified_gmt":"2025-04-04T11:56:53","slug":"german-cbam-authorization-activated","status":"publish","type":"post","link":"https:\/\/nicola-bernard.de\/en\/german-cbam-authorization-activated\/","title":{"rendered":"German CBAM authorization activated"},"content":{"rendered":"<p>As part of the <strong>European Green Deal<\/strong>, the <strong>Carbon Border Adjustment Mechanism (CBAM)<\/strong> was created to ensure that imported goods incur the same CO2 costs as goods produced in the EU. The authorization procedure for CBAM applicants has now been opened: From 01.01.2026, only <strong>authorized CBAM declarants<\/strong> will be allowed to import CO\u2082-intensive goods into the EU customs territory.<\/p>\n<p>All companies that import goods from <strong>Annex I of the <\/strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:32023R0956\" target=\"_blank\" rel=\"noopener\"><strong>CBAM Regulation (Regulation (EU) 2023\/956)<\/strong><\/a> are affected, including:<\/p>\n<ul>\n<li>Cement<\/li>\n<li>Electricity<\/li>\n<li>Fertilisers<\/li>\n<li>Iron and steel<\/li>\n<li>Aluminium<\/li>\n<li>Chemicals (hydrogen)<\/li>\n<\/ul>\n<h5><strong>Application via the CBAM register<\/strong><\/h5>\n<p>The application for authorization must be submitted via the <strong>CBAM register<\/strong>, which can be accessed via the German <strong>customs portal<\/strong>. Any <strong>confusion with the CBAM transitional register<\/strong> must be avoided:<\/p>\n<ul>\n<li>The <strong>CBAM Transitional Register<\/strong> will continue to be used for quarterly reporting <strong>until 31 December 2025<\/strong>.<\/li>\n<li>Anyone who is already registered in the <strong>CBAM Transitional Register<\/strong> will automatically receive access to the <strong>CBAM Register<\/strong>.<\/li>\n<li>If you are not yet registered, you will need to log in to the <strong>customs portal<\/strong>, for which an <strong>ELSTER certificate<\/strong> is required.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h5><strong>What impact does the Omnibus I package have?<\/strong><\/h5>\n<p>On <strong>26 February 2025<\/strong>, the European Commission proposed changes to the <strong>CBAM Regulation<\/strong> as part of the <strong>Omnibus I package<\/strong>. One key change would be the introduction of a <strong>volume threshold of 50 tonnes of CBAM goods per year<\/strong>. If this regulation comes into force, <strong>companies with lower import volumes would be exempt<\/strong> <strong>from the CBAM obligations<\/strong>.<\/p>\n<p>The Commission assumes that this could reduce the number of CBAM declarants by<strong> around 90%<\/strong>, while still <strong>covering 99% of CO\u2082-intensive imported goods<\/strong>. <strong>However, it is still unclear whether and when these changes will take effect<\/strong>.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h5><strong>Why companies should still register now<\/strong><\/h5>\n<p>Depending on the date of submission, it can take <strong>up to 180 days<\/strong> to process an application for authorization.
