Image source: Pixabay<\/p><\/div>\n<p>Provided they are approved by the European Parliament and the Council of the European Union, new patent regulations will come into force. The EU Commission presented a patent package at the end of April. It deals with the following topics:<\/p>\n<ul>\n<li>Standard Essential Patents (SEP)<\/li>\n<li>compulsory licenses<\/li>\n<li>protection certificates<\/li>\n<\/ul>\n<p><strong>SEP licensing framework for more transparency<\/strong><\/p>\n<p>With the proposed <a href=\"https:\/\/single-market-economy.ec.europa.eu\/publications\/com2023232-proposal-regulation-standard-essential-patents_en\" target=\"_blank\" rel=\"noopener\">SEP licensing framework<\/a>, the EU Commission wants to ensure that the provision and use of Wi-Fi, 5G and Bluetooth is strengthened in the European market. It aims to improve global competitiveness.<\/p>\n<p><strong>Introduction of compulsory licensing<\/strong><\/p>\n<p>In response to the Corona pandemic and the related discussion about patented vaccines, whose production methods were not shared despite enormous demand, the Commission wants to introduce an EU-wide <a href=\"https:\/\/single-market-economy.ec.europa.eu\/publications\/com2023224-proposal-regulation-compulsory-licensing-crisis-management_de\" target=\"_blank\" rel=\"noopener\">compulsory licensing instrument<\/a>. It is to be used exclusively in emergency situations and authorize governments to use patented inventions &#8211; even without the consent of the patent holders.<\/p>\n<p><strong>EU-uniform protection certificate<\/strong><\/p>\n<p>Until now, supplementary protection certificates (SPC) have only applied at national level, which the EU Commission would like to change. Its proposal: <a href=\"https:\/\/single-market-economy.ec.europa.eu\/publications\/proposals-regulations-supplementary-protection-certificates_en\" target=\"_blank\" rel=\"noopener\">an EU-wide uniform protection certificate<\/a> with a centralized examination procedure.
