in the GSP"},"content":{"rendered":"<p><span id=\"result_box\" lang=\"en\"><span title=\"Nach Art. 79 der Durchf\u00fchrungsverordnung zum Zollkodex der Union (UZK-IA) sind aus beg\u00fcnstigten L\u00e4ndern, die mit der Registrierung im System des registrieren Ausf\u00fchrers (REX-System) begonnen haben, nachfolgende Pr\u00e4ferenznachweise zul\u00e4ssig: \">Under Article 79 of the Implementing Regulation to the Union Customs Code (UCC-IA), beneficiary countries which have begun to register in the Registered Exporter System (REX system) are entitled to the following preferential proofs:<br \/>\n<\/span><span title=\"\u2022 f\u00fcr Sendungen, deren Wert der Ursprungserzeugnisse 6.000 Euro nicht \u00fcbersteigt, fertigen Ausf\u00fchrer Erkl\u00e4rungen zum Ursprung aus, \">\u2022 for consignments whose value of originating products does not exceed EUR 6 000, exporters shall provide declarations of origin,<br \/>\n<\/span><span title=\"\u2022 f\u00fcr Sendungen, deren Wert der Ursprungserzeugnisse 6.000 Euro \u00fcbersteigt, fertigen registrierte Ausf\u00fchrer Erkl\u00e4rungen zum Ursprung aus.\">\u2022 for consignments whose value of originating products exceeds EUR 6 000, registered exporters shall provide declarations of origin. <\/span><span title=\"Dar\u00fcber hinaus k\u00f6nnen die zust\u00e4ndigen Beh\u00f6rden in diesen beg\u00fcnstigten L\u00e4ndern w\u00e4hrend eines 12-monatigen \u00dcbergangszeitraums f\u00fcr Sendungen \u00fcber 6.000 Euro auf Antrag noch nicht registrierter Ausf\u00fchrer weiterhin Ursprungszeugnisse nach Formblatt A ausstellen.\">In addition, the competent authorities of these beneficiary countries may continue to issue certificates of origin Form A for a period of 12 months for consignments of more than EUR 6 000 at the request of non-registered exporters. <\/span><span title=\"Eine Verl\u00e4ngerung dieser \u00dcbergangsfrist um weitere 6 Monate ist auf Antrag des beg\u00fcnstigten Landes m\u00f6glich. \">An extension of this transitional period by a further 6 months is possible at the request of the beneficiary country.<\/span><\/span><\/p>\n<p><span title=\"F\u00fcr die ordnungsgem\u00e4\u00dfe Anwendung des REX-Systems und der damit verbundenen Anerkennung ausgefertigter Erkl\u00e4rungen zum Ursprung in der Europ\u00e4ischen Union sind durch die beg\u00fcnstigten L\u00e4nder, die in den Artikeln 70 und 72 UZK-IA festgelegten Voraussetzungen zu erf\u00fcllen.\">For the proper application of the REX system and the associated recognition of originated declarations made in the European Union, the beneficiary countries must comply with the conditions set out in Articles 70 and 72 UCC-IA. <\/span><span title=\"Einige beg\u00fcnstigte L\u00e4nder, die beabsichtigten, am 01.01.2017 mit der Registrierung zu beginnen, haben die Voraussetzungen zur ordnungsgem\u00e4\u00dfen Anwendung des REX-Systems nicht erf\u00fcllt.\">Some beneficiary countries that intend to start registration on 01\/01\/2017 have not met the requirements for the proper application of the REX system. <\/span><span title=\"Gleichzeitig endete der 12-monatige \u00dcbergangszeitraum zum 31.12.2017, ohne dass eine Verl\u00e4ngerung beantragt wurde.\">At the same time, the 12-month transitional period ended on 31.12.2017, without an extension being requested. <\/span><span title=\"Das bedeutet, dass die in diesen L\u00e4ndern seit dem 01.01.2018 ausgestellten Ursprungszeugnisse nach Formblatt A bzw. ausgefertigte Erkl\u00e4rungen zum Ursprung in der Europ\u00e4ischen Union f\u00fcr eine Pr\u00e4ferenzgew\u00e4hrung nicht anerkannt werden d\u00fcrfen.\">This means that certificates of origin Form A issued in these countries since 01.01.2018 or declarations of origin issued in the European Union may not be accepted for preferential treatment. <\/span><span title=\"Diese L\u00e4nder sind somit derzeit faktisch vom APS ausgeschlossen. \">These countries are therefore currently excluded from the GSP.<br \/>\n<\/span><span title=\"Die Europ\u00e4ische Kommission hat hierzu n\u00e4here Informationen, insbesondere welche L\u00e4nder im Einzelnen betroffen sind, in einer Tabelle ver\u00f6ffentlicht: \">For this purpose, the European Commission has published a table <a href=\"https:\/\/ec.europa.eu\/taxation_customs\/business\/calculation-customs-duties\/rules-origin\/general-aspects-preferential-origin\/arrangements-list\/generalised-system-preferences\/the_register_exporter_system_en\">in a table<\/a>, in particular which countries are affected in detail:<\/span><\/p>\n<p><span title=\"Im Einzelnen sind dies derzeit nachfolgende L\u00e4nder, die am 01.01.2017 mit der Registrierung begonnen haben, das REX-System aber noch nicht ordnungsgem\u00e4\u00df anwenden und deren \u00dcbergangszeitraum bereits beendet ist: \">Specifically, these are currently the following countries that have started to register on 01.01.2017 but have not yet properly applied the REX system and whose transition period has already ended:<br \/>\n<\/span><span title=\"Central African Republic, Congo, Cook Islands, Djibouti, Equatorial Guinea, Kiribati, Liberia, Mali, Micronesia, Nauru, Sao Tom\u00e9 &amp; Principe, Sierra Leone, Somalia, South Soudan, Timor Leste, Togo, Tuvalu und Yemen. \">Central African Republic, Congo, Cook Islands, Djibouti, Equatorial Guinea, Kiribati, Liberia, Mali, Micronesia, Nauru, Sao Tome &amp; Principe, Sierra Leone, Somalia, South Soudan, Timor Leste, Togo, Tuvalu and Yemen.<\/span><\/p>\n<p><span title=\"Nach Art. 102 UZK-IA Abs. 3 UZK-IA hat der Zollanmelder bei Importen aus beg\u00fcnstigten L\u00e4ndern vor der Anmeldung der Waren zur \u00dcberlassung zum zollrechtlich freien Verkehr zu pr\u00fcfen, ob die Voraussetzungen f\u00fcr eine Pr\u00e4ferenzgew\u00e4hrung erf\u00fcllt sind.\">According to Article 102 UZK-IA (3) UCC-IA, the declarant must check, in the case of imports from beneficiary countries, before declaring the goods for release for free circulation, that the conditions for granting preferential treatment have been fulfilled. <\/span><span title=\"Dies umfasst auch die Pr\u00fcfung, ob ein zul\u00e4ssiger Pr\u00e4ferenznachweis vorliegt.\">This also includes the examination of whether there is a permissible
